§ 1 Sweepstake

The competition is organized by Nemetschek SE, Konrad-Zuse-Platz 1, 81829 Munich (hereinafter uniformly "Nemetschek").

§ 2 Participation

(1) Only natural persons who have reached the age of 18 are entitled to participate.

(2) Each participant may only participate in his/her own name and only once per competition.

(3) Only those who attend Digital Construction Week 2022 (DCW) and meet the requirements specified under §4 are eligible to participate.

§ 3 Prize

(1) As part of the competition, Nemetschek will raffle an Oculus Quest 2 (VR goggles).

(2) The winner is responsible for any taxation of the prize.

(3) Please note that participation in the Stamp Challenge is subject to certain conditions. The prize is not transferable.

(4) An exchange or cash payment of the prize is excluded.

(5) If circumstances arise for which Nemetschek is not responsible, the respective winner will accept an appropriate substitute prize.

§ 4 Participation

(1) The competition takes place in the period from 18.05.2022 to 19.05.2022. Participation is only possible within this participation period.

(2) Participation is exclusively online. In order to participate in the sweepstakes, all stamps of the participating Nemetschek brands/companies must be collected in the DCW flyer, a photo of it must be taken, it must be uploaded to Instagram, shared with #NGroupStampChallenge and tagged @nemetschekgroup.
Entries received after the closing date will not be considered in the draw.

(3) The participant is responsible for the correctness of the data provided to process the participant's prize draw (first and last name, company, address, e-mail address, etc.).

§ 5 Exclusion from the competition

(1) Employees of Nemetschek or its parent companies and its affiliated companies as well as their respective relatives are excluded from participation.

(2) In the event of a breach of these conditions of participation, Nemetschek reserves the right to exclude participants from the competition.

(3) Persons who use unauthorized aids or otherwise obtain advantages by manipulating the competition will also be excluded. In such cases, prizes may also be subsequently disallowed and reclaimed.

(4) Anyone who makes false or misleading statements in connection with participation in the prize draw or provides untrue personal information shall also be excluded.

§ 6 Execution and settlement

(1) All participants who have fulfilled the requirements of § 4 by the closing date for entries will be selected by lot. A winner will be drawn at random. Only one prize can be won per participant in a competition.

(2) The winner will be notified by Nemetschek within 14 days of the end of the competition by direct message via Instagram. The claim to the prize arises exclusively upon receipt of the prize notification.

(3) If the winner does not contact Nemetschek within four weeks after sending the prize notification Instagram message, the claim to the prize shall lapse without replacement and a new winner shall be determined by lot.

(4) The claim to the prize also expires if the transmission of the prize cannot take place within 6 months after the first notification of the prize for reasons that lie in the responsibility, in the sphere of influence or in the person of the winner.

(5) The prize to be won as part of the competition will be delivered to the winner by mail to the address provided by the winner. As a rule, the delivery will be made within 4 weeks after notification of the prize.

(6) Delivery by mail is free of charge within the Federal Republic of Germany. Any additional transport costs and customs duties shall be borne by the winner. The place of performance remains the registered office of Nemetschek, despite the assumption of shipping costs.

(7) The prize cannot be paid out in cash.

§ 7 Warranty and liability

(1) Nemetschek is not liable for material defects and defects of title of the prize as well as for damages from injury to life, body or health, which may arise from the use of the prize.

(2) Nemetschek is not liable for the availability of the Instagram Internet site and its own Instagram Internet site. Nemetschek is also not liable for any transmission errors.
 

§ 8 Premature termination of the competition

Nemetschek reserves the right to cancel, terminate or change the course of the competition at any time without prior notice. Nemetschek will make use of this option in particular if, for technical reasons (e.g. computer virus, manipulation of or errors in software and hardware) or legal reasons, proper execution of the game cannot be guaranteed. If such termination is caused by the conduct of a participant, Nemetschek may demand compensation from such participant for the damage incurred.

§ 9 Data Protection and Consent

(1) Personal data must be provided in order to receive the prize.

(2) The personal data collected will be used by Nemetschek for the purpose of conducting the prize draw (Art. 6 I 1b) DSGVO).

(3) In this context, Nemetschek is entitled to transmit the winner's data to cooperation partners in order to enable the implementation, e.g. the delivery of the prize. Otherwise, the data will not be passed on to third parties not involved in the competition.

(4) All data will only be stored for the purpose and for the duration of the competition and will be deleted after expiry of the competition or settlement of the prize, unless there are other legal grounds for processing or statutory retention obligations.

(5) In the event of a win, the winner agrees to the publication of his/her full name as well as the name of the specified company on the Instagram channel of Nemetschek. The public announcement of the winner is made without guarantee.
The participant may revoke his/her declared consent at any time. The revocation causes the withdrawal from the participation in the sweepstakes. The revocation must be sent in writing to mediarelations@nemetschek.com.

(6) The participant may at any time request information about the data stored about him and/or object to the storage and/or use of his data with effect for the future and request the correction, deletion or restriction of the processing of his personal data.

§ 10 Miscellaneous

(1) Legal recourse is excluded.

(2) The law of the Federal Republic of Germany shall apply exclusively. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.

(3) If the participant is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this competition shall be Munich, unless an exclusive place of jurisdiction is given.

(4) Should individual provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining terms and conditions of participation and implementation. The parties are obligated to replace void or ineffective provisions with a provision whose economic and legal meaning comes as close as possible to the void or ineffective provision. The same shall apply if gaps requiring supplementation become apparent during the implementation of these terms and conditions.
